Company Policy
The Personal Data Protection Act B.E. 2562 (PDPA) is a law that grants rights to data subjects by establishing standards for protecting personal data and ensuring its use aligns with the consent granted by data subjects. The PDPA took effect on 1 June 2022. The Company places high importance on the collection, use, and disclosure of customers’ personal data in order to safeguard such data.
Purpose of the Company
Koolpunt Property Co., Ltd. and its affiliates engage in the business of land development, which involves the personal data of customers. The Company has therefore established this policy to protect the personal data of customers, employees, and business partners that the Company collects, uses, or discloses.
Definitions
Personal Data means
Information about a person that enables that person to be identified, whether directly or indirectly, but not including data of a deceased person specifically. Examples include first and last name, nickname, ID card number, passport number, bank details, credit card details, address, email, and telephone number of customers.
Sensitive Personal Data means
- Personal data relating to race, ethnicity, political opinions, religious or philosophical beliefs, sexual behavior, etc., which is sensitive personal data. If such data is leaked, it could cause greater harm to the data subject than ordinary personal data.
Data Subject means
- Customers, business partners, and employees of customers of Koolpunt Property Co., Ltd. and its affiliates.
Protection of Personal Data
- The collection, use, or disclosure of personal data is prohibited unless the data subject has given consent prior to or at the time of such action, except as permitted by the Personal Data Protection Act or other laws.
- Consent must be obtained explicitly, in writing or via electronic means, unless the nature of the request makes it impossible to obtain consent in such ways.
- When requesting consent from a data subject, the data controller must inform the data subject of the purpose of collection, use, or disclosure of personal data. The consent request must be clearly separated from other content, presented in an easily accessible and understandable form, written in plain language, and not deceptive or misleading regarding such purposes.
- When requesting consent from a data subject, the controller must give the utmost consideration to the data subject’s freedom.
- A data subject may withdraw consent at any time, and withdrawing consent must be as easy as giving it, except where the right of withdrawal is restricted by law or by a contract that benefits the data subject. Withdrawal of consent does not affect the collection, use, or disclosure of personal data that the data subject has previously consented to lawfully.
- If the withdrawal of consent affects the data subject in any way, the data controller must inform the data subject of the consequences of such withdrawal.

Data Controller
- Means a person or juristic person with the authority to make decisions regarding the collection, use, or disclosure of personal data. In this case, it refers to Koolpunt Property Co., Ltd. and its affiliates, including employees of the Company and its affiliates who are responsible for collecting, using, or disclosing personal data.
Data Processor
- Means a person or juristic person who carries out the collection, use, or disclosure of personal data under the instructions of, or on behalf of, the data controller — and who is not the data controller. In this case, it refers to Koolpunt Property Co., Ltd. and its affiliates, including employees of the Company and its affiliates who are responsible for collecting, using, or disclosing personal data.
Koolpunt Property Co., Ltd. and its affiliates pledge to our customers that the Company will fully comply with the Personal Data Protection Act B.E. 2562 in every respect, in order to protect personal data and act in the best interests of our customers.
